Terms of Service
I. Service Overlook
Innovative Apartments and Screenings Services is a complete screening service for landlords, management companies, etc. It is a paid service, which we provide to our clients, landlords and potential tenants alike. Because of our excellent relationship with many landlords and management companies due to years of doing business together, the landlords provide NO FEE listings to us and in turn, we provide them to our clients for FREE in exchange for qualified potential tenants. We put you in contact directly with the management or the landlord. Our service is not limited just by our listings alone. We make every effort in placing you into an apartment.
Every day renters are finding apartments in New York City without high brokerage fees. These people are Innovative Apartments clients who have found a better way. Our service is cost effective, efficient and easy to use. Brokerage fees often times run into thousands of dollars. The average broker fee in Manhattan for a rental is 15% of one year's rent.
The information is gathered from numerous sources including polling over nine hundred landlords each and every day. It achieves participation from both major landlords and smaller property owners throughout New York City. These landlords and owners make their properties available for rent to the Real Estate market every day. We also maintain numerous proprietary sources. We receive almost all of our information directly from the source.
We update this information as it becomes available every day. You receive up to the minute information. The information is valuable to the apartment seeker. Its purpose is to assist you in finding a suitable living arrangement and save.
I. Credit Report Policy
Upon registration, your complete credit and background checks were ordered from Transunion and should be sent to you automatically via email 48 to 72 hours after registering with the service (business days). Many internet and e-mail providers have strong spam protection, which may block our e-mails. If you are using any internet or e-mail provider, which has a strong spam protection and/or a firewall, your credit report may not be delivered to you successfully. If you do not receive your credit report within two to three days after registration (Business Hours – 10am-6pm M-F) of registration, please call the Service Manager as soon as possible at Extension 300 or you can e-mail him at: service@inapts.com. If you do not call us or e-mail us to request your credit report, it may or will not be resent to you. The type of credit report you will receive, will not include your FICO score. It will be a complete itemized credit history for the past 7 years.
III. Customer Service Policy
Customer Service can be reached Monday through Friday, 10am to 6pm. Customer service is there to assist you in any way. For information on specific listings, technical assistance, etc, please dial extension 204 or 401. For any other matter, accounting, legal matters with your current landlord, lease signing, credit reports, background checks, please dial extension 300 (Monday through Friday 10am – 6pm).
IV. Listings Policy
You have numerous options on how to receive listings and confirmation on specific apartments.
a.) On the Web – Our listings are just a click away. You may access our listings on our online database, which is available to you 24 hours per day, 7 days per week. You can logon to http://www.inapts.com. Your username is your e-mail address and your password is your zip code. In the event you can not access our online database, please call the customer service during the normal business hours of 10am to 6pm, Monday through Friday.
b.) Over the Phone – You may call our customer service at any time during the normal business hours of 10am to 6pm, Monday through Friday and request listings over the phone. Our agents are standing by to assist you.
c.) Private Listings – In some cases, we may have a landlord that only wants to release his information only to the clients who may qualify for his apartment based on his client criteria, qualifications, etc. In most cases, we would give YOUR contact information and he would contact you if he/she approves your application.
We do not provide listings on weekends and after 6pm, as most management offices operate during normal business hours.
V. Privacy Policy
We value your privacy. Any information, which Innovative Apartments and Screening Services collects from our clients, is kept strictly confidential and will not be sold, reused, rented, disclosed, or loaned except for the purposes of providing its clients complete information to the landlords only for the purposes of renting a property as per the NYS Department of Housing law. Any information you give to us will be held with the utmost care and will not be used in ways that you have not consented to. We may, however, use your e-mail address and/or phone number to send you information about our site, apartment information, and future services. Innovative Apartments and Screening Services is not affiliated with any marketing agency and/or any advertising company.
VI. Acceptable Use
By registering you affirm that you are not:
1) misusing this information,
2) gifting or selling this information to anyone who will not be living in the same apartment with you,
3) reselling any of the information obtained through our service,
4) not a real estate broker or agent using the accessed information for professional service.
Innovative Apartments and Screening Services Inc reserves the right to terminate any account for violation of any of these terms.
VII. Disclaimer
Innovative Apartments and Screening Services Inc offers a complete screening for landlords, management companies, rental offices, private owners etc. It makes no offer of any specific apartment or a listing. It offers a background check in addition to a credit check to members. It achieves participation from both major Landlords and smaller Property Owners. Innovative Apartments does not guarantee full acceptation of our credit check/background check to every landlord/management company in the New York City rental market. In the event a landlord/management company does not accept the credit check 100% of that fee is refunded (market/reporting agency value not 3rd party value). In some cases, landlords, management companies, leasing offices, etc may ask for an application fee, which is used solely on running their office and may not be refundable. Innovative Apartments and Screening Service Inc. is not responsible for any additional fees (application fees, etc), which they may be required to run/accept your application. Innovative Apartments and Screening Services Inc contacts the landlord or his representative when ever possible to confirm the rental price, location, apartment number, availability, and other general terms of the rental contract. Innovative Apartments and Screening Services Inc makes no representation, warranty or guarantee of the accuracy of the information it obtains and provides to its member. We advise that you seek advice from an Attorney on any Lease you enter into. Innovative Apartments and Screening Services Inc exerts its best efforts to make sure that the information is reliable. Innovative Apartments and Screening Services Inc has no role beyond providing the information. Innovative Apartments and Screening Services Inc makes no claim as to the quantity of listings it may provide. However in your enrollment of our services we will provide apartments to see as needed per the subscribers request based on availability.
Due to the fluctuating nature of the real estate marketplace and the possibility of changing search parameters, your updates may or may not include new listings. Innovative Apartments cannot be held responsible for the condition, look, size, layout or nature of the apartments enrolled in our program.
Innovative Apartments is not responsible for any errors or omissions in listing information as all information is gathered from sources deemed to be reliable.
Innovative Apartments reserves the right to terminate any account for misuse of the listings information or credit check/background check we provided.
VIII. Appointment Setting / Guaranteed Listings
Innovative Apartments and Screening Services Inc makes every effort to provide the most current access information for our listings. Persons involved in granting access to apartments are employees or agents of the landlord, not Innovative Apartments and Screening Services Inc. As such Innovative Apartments and Screening Services Inc has no control over apartment access and therefore can not guarantee the accuracy of access information nor can Innovative Apartments and Screening Services Inc be held liable for difficulty in getting access to apartments. As such, Innovative Apartments and Screening Services is also not liable if the landlord does not choose any of our customers based on their qualifications, credit history, or any other factors, which the landlord may use to choose a qualified potential tenant due to the competitive and fluid market.
IX. Projected Move-In Date Guarantee
Due to the fluctuating nature of the real estate market, we do not guarantee that you will be able to move to an apartment on the date you have requested.
We do not have any control over the landlords or the buildings. The landlords may have their own move-in date, which may not be negotiable.
X. Service Period
Service is provided until you find an apartment. Your access to the database is automatically deactivated after (60) days, which can be reactivated upon request at no extra charge.
XI. Rental Market
Due to the nature of a fluctuating marketplace, and your specific search criteria, (such as size, price, location, etc.) on any given day, your updates may or may not include new listings. Innovative Apartments, Inc. cannot be held responsible for the look, nature, size, and layout of apartments or the condition they are delivered in. We are not responsible for any errors or omissions in listing information; all information was gathered from sources deemed to be reliable. Innovative Apartments Inc. operates solely as a Pre-screening agency.
XII. Postpone service
Postpone service: You may request your account be put on hold for any unforeseen circumstances for a period of 12 months after initial registration. The initial request for your account to be put on hold must be done within the first 60 days of service.
XIII. Refund Policy
The cost of the service is a total of $225.00 plus New York State Sales tax of $9.00. You will pay this service charge at the start of your service.
The total cost of this Service Agreement is composed of two components:
1. Our Apartment Listings Information Fee, for which you are prepaying -$120.
2. Our User Services, which includes our, Customer Support and Credit Check / Background Check fees, etc -$105.
The User Services include part or all of the following:

You hereby agree to the following in recognition of the fact that, if you cancel service after it has started, we are unable to take back any of the information we have provided:
Each of the first eight (8) consecutive days of service represents a separate Service Agreement for that day's apartment listing information, for which you have prepaid $15 per day. Since service for each of those days constitutes a separate Service Agreement, it is your right to apply for a pro-rated refund during the first eight (8) consecutive days of service. Your refund will be pro-rated at the rate of $15/day up to the total $120 listings fee you paid. Our Customer Support, Credit check, and our additional user services are not refundable.
After the eighth consecutive day of service, you may continue using the service at no additional cost to you for the maximum term under this Agreement, but you are not entitled to any refund after eight (8) days from when you registered for service.
If you have rented an apartment from our landlord/management database, you are not entitled to any refund, even if you found the apartment on the first day of signing up.
A. Your request for a refund must be in writing and signed by you, the Customer.
B. Your refund request must be mailed to us by first class mail.
You may fax (646-349-4031) or email us (refund@inapts.com) your intent to request a refund. We will inactivate your account as of the date we receive the email or fax. A refund will be issued if it is due. Full details on processing a refund will be emailed to you once you request a refund. You must still send us your refund request by mail. No refunds will be made unless we have officially received your signed refund request.
Innovative Apartments reserves the right to request and verify your address for a period of up to six months from the time that you cancel service and request a refund. You agree to furnish proof of current residence address, or forfeit any refund that might otherwise be due to you. If we have refunded you money and later discover that you have moved into a property in our landlord inventory, we reserve the right to re-charge you the refunded amount. |
